IMPORTANT NOTICE
This document forms the entire agreement between AD Pest & Termite Control (“Company”) and the Customer for all pest management, termite management, inspection, treatment, monitoring, reporting, sanitisation and related services.
By accepting a quote, booking a service, making payment, signing a work order, accepting a report, or allowing our technicians to perform services, the Customer agrees to be bound by these Terms and Conditions.
- SERVICES COVERED
This agreement applies to all services including but not limited to:
- Residential Pest Control • Commercial Pest Control • Industrial Pest Control • Termite Inspections • AS4349.3 Timber Pest Inspections • Pre-Purchase Timber Pest Inspections • Pre-Construction Termite Treatments • Chemical Termite Barriers • Physical Termite Barriers • Termite Monitoring Systems • Rodent Control • Bird Control • Ant Control • Cockroach Control • Spider Control • Flea Treatments • Bed Bug Treatments • Mosquito Treatments • Wasp Treatments • Sanitisation Services • Disinfection Services • Fogging Services • Emergency Pest Control Services
- CUSTOMER RESPONSIBILITIES
The Customer must:
- Provide safe access. • Provide accurate property information. • Identify hazards and risks. • Follow all technician recommendations. • Maintain reasonable hygiene standards. • Prevent disturbance of treated areas. • Notify the Company of changes affecting treatments.
Failure to comply may reduce treatment effectiveness and void warranties.
- SITE ACCESS REQUIREMENTS
The Company may refuse or postpone services where:
- Access is restricted. • Safety risks exist. • Dangerous animals are present. • Electrical hazards exist. • Asbestos is suspected. • Structural instability exists. • Environmental hazards are identified.
Additional attendance fees may apply where repeat visits are required.
- TERMITE INSPECTION TERMS
All termite inspections are visual, non-invasive inspections unless otherwise stated.
No inspection can guarantee:
- Absence of termites. • Absence of termite damage. • Discovery of all concealed activity. • Future termite-free conditions.
Areas not reasonably accessible are excluded from inspection findings.
- HIDDEN AREA DISCLAIMER
The Company accepts no responsibility for pest activity, termite activity, timber damage or structural issues concealed within:
- Wall cavities • Roof voids • Subfloors • Insulated areas • Stored goods • Furniture • Enclosed construction elements • Inaccessible locations
- TERMITE MANAGEMENT SYSTEMS
Termite barriers, monitoring systems and treatments reduce termite risk but cannot guarantee permanent protection.
Treatment effectiveness may be affected by:
- Landscaping • Excavation • Plumbing leaks • Drainage defects • Building alterations • Soil disturbance • Flooding • Tree removal • Structural changes
Annual termite inspections are strongly recommended.
- PRE-CONSTRUCTION TERMITE SERVICES
Pre-construction termite systems are installed based on site conditions and building plans available at the time of installation.
Subsequent construction changes may affect effectiveness.
The builder and owner are responsible for ensuring termite management systems are not disturbed during construction.
- GENERAL PEST CONTROL LIMITATIONS
Pest control reduces pest activity but cannot guarantee complete elimination.
Results may vary depending on:
- Property condition • Environmental conditions • Neighbouring infestations • Hygiene standards • Building design • Occupant activities
- POST-TREATMENT SAFETY INSTRUCTIONS
Unless otherwise advised:
- Avoid touching treated surfaces until completely dry. • Avoid treated areas for approximately 3-4 hours after treatment. • Keep children away until surfaces are dry. • Keep pets away until surfaces are dry. • Remove food items before treatment. • Remove pet bowls before treatment. • Remove washing from clotheslines before external treatments. • Follow all technician instructions.
- DISINFECTION & FOGGING SERVICES
Disinfection and fogging services assist in reducing contamination.
The Company does not guarantee:
- Elimination of all bacteria. • Elimination of all viruses. • Elimination of all mould. • Prevention of future contamination.
- WARRANTY CONDITIONS
Any warranty is subject to:
- Full payment. • Compliance with recommendations. • Annual inspections where applicable. • No interference with treatment systems. • Proper maintenance of the property.
Warranties may become void where conditions are not met.
- MOISTURE & DRAINAGE EXCLUSIONS
Warranty coverage may be excluded where:
- Water leaks exist. • Drainage defects exist. • Excessive moisture exists. • Ventilation deficiencies exist. • Water pooling occurs.
- PRE-EXISTING DAMAGE
The Company is not responsible for:
- Existing termite damage. • Existing timber decay. • Existing pest damage. • Existing structural defects. • Existing moisture issues.
- PROPERTY DAMAGE DISCLAIMER
The Customer must identify:
- Electrical wiring • Water pipes • Gas lines • Drainage systems • Underground services
The Company is not liable for damage caused by inaccurate or incomplete information supplied by the Customer.
- ASBESTOS DISCLAIMER
The Company will not intentionally disturb asbestos-containing materials.
Services may be suspended until asbestos risks are addressed.
- ELECTRONIC EQUIPMENT DISCLAIMER
The Customer is responsible for protecting:
- Computers • Security systems • Smoke detectors • Appliances • Sensitive electronic devices
- EQUIPMENT OWNERSHIP
Monitoring stations, bait stations, sensors, electronic systems and related equipment supplied by the Company remain Company property unless otherwise agreed in writing.
Customers must not remove, relocate or tamper with equipment.
- PAYMENT TERMS
Invoices are payable by the due date stated.
Failure to pay may result in:
- Service suspension • Cancellation of warranties • Debt collection • Legal action • Recovery of collection costs
- INDEMNITY
To the extent permitted by law, the Customer indemnifies AD Pest & Termite Control against claims arising from:
- Inaccurate information supplied by the Customer. • Unsafe conditions at the property. • Undisclosed hazards. • Customer negligence. • Failure to follow recommendations.
- LIMITATION OF LIABILITY
To the maximum extent permitted by law:
The Company shall not be liable for:
- Indirect loss • Consequential loss • Loss of profits • Loss of revenue • Loss of opportunity • Business interruption
Total liability shall not exceed the amount paid for the relevant service.
- AUSTRALIAN CONSUMER LAW
Nothing in this agreement excludes rights available under Australian Consumer Law.
Where permitted by law, remedies may be limited to:
- Re-supply of services; or • Payment of the cost of re-supplying services.
- PRIVACY
Personal information may be collected for:
- Service delivery • Reporting • Warranty administration • Regulatory compliance • Invoicing • Customer communication
Information is managed in accordance with Australian privacy laws.
- PHOTOGRAPHY & RECORD KEEPING
The Company may collect:
- Photographs • Thermal images • Moisture readings • Site notes • Inspection records • Service records
for reporting, compliance, warranty, training and insurance purposes.
- HEALTH & SAFETY
The Customer must provide a safe working environment.
The Company reserves the right to stop or refuse work where technician safety may be compromised.
- WEATHER & ENVIRONMENTAL CONDITIONS
Outdoor treatments may be affected by:
- Rain • Flooding • Wind • Irrigation systems • Extreme temperatures • Environmental conditions
The Company is not responsible for reduced effectiveness caused by these factors.
- ANNUAL INSPECTION REQUIREMENTS
Annual termite inspections are recommended and may be required to maintain certain warranties.
Higher-risk properties may require more frequent inspections.
- DISPUTE RESOLUTION
The parties agree to attempt to resolve disputes through good faith discussions before commencing legal proceedings, except where urgent relief is required.
- FORCE MAJEURE
The Company is not liable for delays or inability to perform services caused by:
- Natural disasters • Floods • Fires • Pandemics • Government restrictions • Supply shortages • Industrial action • Cyber incidents • Power outages
- INSURANCE
Customers are responsible for maintaining adequate building and contents insurance.
The Company does not provide insurance coverage for pest or termite damage.
- BUILDING & STRUCTURAL DISCLAIMER
The Company is not a builder, engineer, architect, electrician or plumber.
Any comments regarding building conditions are general observations only and should not be relied upon as professional engineering or building advice.
- NO TRANSFER OF WARRANTY
Any warranty issued by the Company is personal to the original Customer unless transferred in writing by AD Pest & Termite Control.
- SEVERABILITY
If any clause is found to be invalid or unenforceable, the remaining provisions remain in effect.
- SURVIVAL OF TERMS
Payment obligations, indemnities, liability limitations, privacy obligations, dispute resolution provisions and warranty conditions survive completion or termination of services.
- GOVERNING LAW
This agreement is governed by the laws of Australia and the State or Territory where the services are performed.
- DEFINITIONS
Company means AD Pest & Termite Control.
Customer means any owner, occupier, tenant, builder, company, corporation or authorised representative engaging the Company.
Property means all buildings, structures, gardens, landscaping and surrounding land where services are performed.
Service means any inspection, treatment, monitoring, installation, report or recommendation provided by the Company.
Equipment means any bait station, monitoring station, electronic device, sensor, trap or pest management equipment supplied by the Company.
