IMPORTANT CUSTOMER INFORMATION
GENERAL PEST CONTROL TERMS AND CONDITIONS
These Terms and Conditions form the agreement between AD Pest & Termite Control (ABN 76991175496) and the customer identified in the quotation, invoice, work order, service agreement, treatment proposal, booking confirmation, or other service documentation.
By accepting a quotation, booking a service, requesting works, signing a service agreement, allowing work to commence, or making payment, the customer confirms they have read, understood, and accepted these Terms and Conditions.
These Terms and Conditions apply to all residential, commercial, industrial, strata, government, educational, healthcare, hospitality, property management, and related pest management services supplied by AD Pest & Termite Control.
1. Scope of Services
1.1 Services Provided
AD Pest & Termite Control will provide pest management services using reasonable care, skill, professional judgment, and recognised industry practices.
Services may include but are not limited to:
- General pest control
- Cockroach treatments
- Ant treatments
- Spider treatments
- Rodent control
- Rat and mouse management
- Flea treatments
- Silverfish treatments
- Wasp treatments
- Bee management where permitted by law
- Stored product pest management
- Monitoring programs
- Commercial pest management
- Preventative pest programs
- Pest inspections
- Reporting and recommendations
- Proofing recommendations
- Hygiene recommendations
1.2 Scope Limitation
The exact scope of works is limited to the services specifically identified in the quotation, invoice, treatment proposal, report, certificate, service agreement, or work order.
1.3 No Guarantee of Pest-Free Premises
The customer acknowledges that pest management is a risk reduction service and not an insurance policy. No representation is made that pests will be permanently eliminated, prevented from re-entering, or unable to return in the future.
1.4 Additional Services
Any services outside the agreed scope may attract additional fees and require separate approval.
2. Site Access and Property Conditions
2.1 Access Requirements
The customer must provide safe, unrestricted, and reasonable access to all treatment areas required to perform the services.
2.2 Customer Responsibility
The customer is responsible for ensuring:
- Access gates are unlocked.
- Required occupants are notified.
- Treatment areas are accessible.
- Pets and animals are secured.
- Safety risks are disclosed.
- Site preparation instructions are followed.
2.3 Failure to Provide Access
Where technicians attend and cannot proceed due to customer-related circumstances, AD Pest & Termite Control may charge reasonable:
- Attendance fees
- Travel costs
- Waiting time charges
- Rescheduling fees
- Administrative costs
2.4 Unsafe Conditions
AD Pest & Termite Control may postpone, suspend, or refuse services where site conditions are considered unsafe, hazardous, illegal, or unsuitable for treatment.
2.5 Commercial and Construction Sites
Customers must comply with all induction requirements, workplace safety obligations, access procedures, permits, and site rules necessary for safe service delivery.
3. Customer Responsibilities
3.1 Information Accuracy
The customer warrants that all information supplied regarding the property, pest activity, treatment history, access conditions, and site hazards is accurate and complete.
3.2 Ongoing Obligations
The customer agrees to:
- Follow preparation instructions.
- Follow post-treatment instructions.
- Maintain reasonable hygiene standards.
- Remove pest attractants where practical.
- Maintain the property in a reasonable condition.
- Notify AD Pest & Termite Control of relevant changes affecting treatment effectiveness.
3.3 Property Maintenance
The customer acknowledges that pest management effectiveness may be reduced by:
- Water leaks
- Excessive moisture
- Building defects
- Poor sanitation
- Accumulated rubbish
- Vegetation overgrowth
- Structural gaps
- Untreated neighbouring infestations
3.4 Third Party Actions
AD Pest & Termite Control accepts no responsibility for reduced treatment effectiveness resulting from actions or omissions of:
- Owners
- Occupiers
- Tenants
- Contractors
- Builders
- Visitors
- Neighbours
- Third parties
4. Health and Safety Requirements
4.1 Customer Disclosure
Prior to treatment, the customer must advise AD Pest & Termite Control of:
- Allergies
- Respiratory conditions
- Medical concerns
- Pregnancy concerns
- Immunocompromised persons
- Pets
- Birds
- Reptiles
- Fish tanks
- Livestock
- Sensitive environments
4.2 Occupant Safety
Occupants may be required to vacate treatment areas during and after treatment as directed by the technician.
4.3 Food Safety
Customers must ensure:
- Food items are protected or removed.
- Food preparation surfaces are protected.
- Food utensils are protected or removed.
- Food-contact items are secured before treatment.
4.4 Ventilation
Following treatment, customers must ensure appropriate ventilation of treated areas in accordance with technician instructions and product label requirements.
4.5 Compliance
Failure to follow safety instructions may:
- Reduce treatment effectiveness.
- Void service guarantees.
- Void warranty coverage.
- Create health risks for occupants.
4.6 Post-Treatment Safety Requirements
Unless otherwise advised by the technician or required by the product label, customers must avoid touching treated surfaces and treatment areas for a minimum of two (2) to four (4) hours following treatment, or until all treated surfaces are completely dry.
Children, pets, birds, and other animals must be kept away from treated areas until the treatment has dried and the re-entry period advised by the technician has expired.
The customer is solely responsible for ensuring that all occupants, children, visitors, pets, and animals comply with these safety requirements.
AD Pest & Termite Control accepts no responsibility for injury, illness, exposure, contamination, damage, or loss resulting from failure to follow post-treatment instructions or from early entry into treated areas by occupants, children, pets, visitors, contractors, or third parties.
5. Treatment Information and Product Use
5.1 Product Application
All pest management products are applied by licensed technicians in accordance with:
- Australian legislation
- Product labels
- Manufacturer directions
- Industry best practice
- Applicable Australian Standards
5.2 Product Performance
The customer acknowledges that pest control products perform differently depending on:
- Pest species
- Infestation levels
- Environmental conditions
- Building construction
- Weather conditions
- Customer compliance
5.3 Staining and Surface Risk
While reasonable care is taken during treatment, AD Pest & Termite Control accepts no responsibility for staining, discolouration, marking, or damage resulting from:
- Pre-existing conditions
- Hidden defects
- Porous surfaces
- Unsealed materials
- Defective finishes
5.4 Concealed Services Warning
Where drilling, cutting, trenching, injection, fixing, or installation work is required, the customer must provide accurate information regarding:
- Electrical wiring
- Water pipes
- Gas lines
- Communications services
- Drainage systems
- Irrigation systems
- Underground services
AD Pest & Termite Control accepts no liability for damage caused by inaccurate, incomplete, unavailable, or misleading information regarding concealed services.
6. Service Effectiveness and Limitations
6.1 No Absolute Guarantee
AD Pest & Termite Control will provide services using reasonable care and recognised industry practices. However, no pest management treatment, monitoring program, baiting system, exclusion method, inspection service, or recommendation can guarantee complete, immediate, or permanent elimination of pests.
6.2 Factors Beyond Our Control
Treatment effectiveness may be reduced or prevented by factors including:
- Neighbouring infestations
- Untreated adjoining properties
- Building defects
- Water leaks
- High moisture conditions
- Structural gaps
- Environmental conditions
- Seasonal pest pressure
- Poor hygiene
- Landscaping changes
- Renovations
- Stored goods
- Food availability
- Pest migration
6.3 Risk Reduction Service
The customer acknowledges that pest management is intended to reduce pest risk and activity and is not a guarantee against future pest infestation or property damage.
6.4 Re-Infestation
Pests may re-enter or re-establish within treated areas after treatment due to circumstances beyond the reasonable control of AD Pest & Termite Control.
6.5 Additional Treatments
Additional inspections, treatments, monitoring visits, proofing works, sanitation services, exclusion works, or maintenance programs may be recommended and may incur additional fees.
6.6 No Insurance Against Pest Damage
Unless expressly stated in a separate written warranty, AD Pest & Termite Control does not provide insurance, compensation, timber replacement, structural repair, property repair, business interruption cover, or guarantees against pest-related losses.
6.7 Customer Acceptance
By proceeding with the services, the customer acknowledges and accepts the limitations of pest management services described in this clause.
7. Rodent Control Programs
7.1 Purpose of Rodent Services
Rodent management services are intended to reduce rodent populations, minimise rodent activity, and assist with long-term rodent management. Rodent treatments do not guarantee immediate elimination of all rodents from a property.
7.2 Factors Affecting Rodent Control
Rodent activity may continue or reoccur due to factors beyond the reasonable control of AD Pest & Termite Control including:
- Neighbouring infestations
- Untreated adjoining properties
- Building construction defects
- Roof void access points
- Drainage systems
- Food availability
- Storage practices
- Waste management issues
- Environmental conditions
- Seasonal breeding activity
7.3 Ownership of Equipment
Unless sold separately in writing, all bait stations, monitoring devices, traps, locks, keys, identification tags, signage, monitoring systems, and related equipment remain the property of AD Pest & Termite Control.
7.4 Customer Responsibilities
The customer must not:
- Move equipment
- Tamper with equipment
- Relocate equipment
- Open equipment
- Damage equipment
- Remove equipment
- Obstruct equipment
7.5 Equipment Damage
The customer is responsible for the reasonable replacement cost of any equipment that is:
- Lost
- Stolen
- Damaged
- Destroyed
- Vandalised
- Removed without permission
7.6 Exclusions
Unless specifically included in writing, rodent services do not include:
- Building repairs
- Proofing works
- Roof repairs
- Exclusion works
- Wall cavity sanitation
- Insulation replacement
- Dead rodent removal from inaccessible areas
- Odour remediation
- Structural modifications
7.7 No Rodent-Free Guarantee
AD Pest & Termite Control does not guarantee that rodents will permanently vacate, remain absent from, or be prevented from re-entering the property.
7.8 Customer Responsibility for Rodent Bait Stations
Once rodent bait stations, traps, monitoring devices, or other rodent management equipment have been installed, the customer is responsible for ensuring that children, pets, visitors, contractors, and other occupants do not tamper with, move, open, damage, interfere with, or remove the equipment.
The customer must immediately notify AD Pest & Termite Control if any bait station, trap, lock, key, warning label, or monitoring device becomes damaged, missing, opened, disturbed, or inaccessible.
To the maximum extent permitted by law, AD Pest & Termite Control accepts no responsibility for injury, illness, poisoning, contamination, damage, loss, reduced treatment effectiveness, or any other consequence arising from tampering, misuse, interference, vandalism, theft, removal, relocation, or unauthorised access to rodent bait stations or equipment after installation.
The customer acknowledges that responsibility for monitoring children, pets, visitors, contractors, and other occupants around installed rodent management equipment remains solely with the customer after installation.
8. Fees, Invoicing and Payment
8.1 Payment Obligation
The customer agrees to pay all fees, charges, costs, variations, attendance fees, call-out fees, equipment charges, monitoring fees, and other amounts stated in:
- Quotations
- Invoices
- Service agreements
- Work orders
- Approved variations
8.2 Payment Terms
Unless otherwise agreed in writing:
- Residential accounts are payable upon completion.
- Commercial accounts are payable within the period stated on the invoice.
8.3 Overdue Accounts
Where payment remains overdue, AD Pest & Termite Control may:
- Suspend services
- Refuse future bookings
- Cancel warranties
- Withhold reports and certificates
- Engage debt collection services
- Commence legal proceedings
8.4 Recovery Costs
To the maximum extent permitted by law, the customer agrees to pay reasonable:
- Debt recovery costs
- Collection agency fees
- Legal expenses
- Court costs
- Administrative costs
- Interest charges
incurred in recovering overdue amounts.
8.5 No Set-Off
The customer must not withhold, deduct, reduce, offset, or dispute payment unless required by law or agreed in writing.
9. Warranty and Service Guarantees
9.1 Written Warranties Only
No warranty, guarantee, free service period, workmanship warranty, or service guarantee applies unless expressly confirmed in writing by AD Pest & Termite Control.
9.2 Limited Warranty Scope
Any warranty applies only to:
- The specific pest identified.
- The specific treatment area.
- The specific service performed.
- The warranty period stated in writing.
9.3 Conditions of Warranty
Warranty eligibility requires:
- Full payment of all invoices.
- Compliance with recommendations.
- Compliance with preparation instructions.
- Compliance with post-treatment instructions.
- Maintenance of reasonable hygiene conditions.
- Prompt reporting of pest activity.
- No interference with treatment areas or equipment.
9.4 Warranty Exclusions
Any warranty is automatically void where:
- Invoices remain unpaid.
- Building alterations occur.
- Renovations occur.
- Extensions are added.
- Treatments are disturbed.
- Bait stations are moved.
- Pest-conducive conditions remain.
- Water leaks remain unresolved.
- Access is denied.
- Third-party pest control providers perform additional treatments.
9.5 Warranty Remedies
Where a valid warranty claim exists, AD Pest & Termite Control may, at its sole discretion:
- Re-inspect the property.
- Re-treat the affected area.
- Install additional monitoring devices.
- Replace supplied equipment.
9.6 Excluded Losses
To the maximum extent permitted by law, warranties do not cover:
- Structural repairs
- Timber replacement
- Property repairs
- Business interruption
- Loss of profits
- Loss of rent
- Indirect loss
- Consequential loss
- Future infestations outside the warranty period
9.7 Australian Consumer Law
Nothing in this clause excludes rights that cannot legally be excluded under Australian Consumer Law.
9.8 Warranty Limitations and Customer Breach
Any warranty, free service period, or service guarantee applies only to the specific pest species and treatment areas identified in the quotation, invoice, report, certificate, or service documentation.
AD Pest & Termite Control does not guarantee that all pests will be permanently eliminated or that new pest activity will not occur in untreated areas, neighbouring properties, roof voids, wall cavities, gardens, subfloors, external areas, or other locations outside the original treatment scope.
Where a warranty service call is requested, AD Pest & Termite Control will inspect the reported activity and determine whether it relates to the original treatment area and pest species covered by the warranty.
If inspection determines that:
- The pest activity is unrelated to the original treatment.
- The pest activity occurs in untreated areas.
- A different pest species is involved.
- The customer has failed to follow recommendations.
- Hygiene, sanitation, moisture, or property maintenance issues exist.
- Treatment areas have been disturbed.
- Building alterations, renovations, landscaping, or construction works have occurred.
- Bait stations, traps, monitoring devices, or treatment systems have been moved, damaged, removed, or tampered with.
- Any warranty condition has been breached by the customer.
Then the warranty will be considered void for that issue and the customer will be responsible for all applicable inspection fees, call-out fees, treatment fees, replacement equipment costs, and any additional services required.
AD Pest & Termite Control reserves the right to charge its current standard rates where a warranty claim is found to be outside the warranty coverage or where the customer has breached any warranty condition.
10. Limitation of Liability
10.1 General Limitation
To the maximum extent permitted by law, AD Pest & Termite Control excludes all liability for indirect, incidental, consequential, special, exemplary, punitive, or economic losses.
10.2 Examples of Excluded Losses
Excluded losses include:
- Loss of profit
- Loss of income
- Loss of rent
- Business interruption
- Loss of goodwill
- Loss of opportunity
- Delay costs
- Production losses
10.3 Maximum Liability
Where liability cannot be excluded by law, AD Pest & Termite Control’s total liability is limited to:
- Re-supplying the services.
- Re-performing the services.
- Replacing supplied equipment.
- Paying the reasonable cost of replacement services.
10.4 No Liability for External Factors
AD Pest & Termite Control is not responsible for loss or damage arising from:
- Undisclosed site conditions
- Building defects
- Water leaks
- Third-party actions
- Customer non-compliance
- Pest migration
- Neighbouring infestations
10.5 Single Recovery Rule
A customer may not recover compensation more than once for the same loss.
11. Australian Consumer Law
11.1 Statutory Rights
Nothing within these Terms and Conditions excludes, restricts, or modifies any rights, guarantees, warranties, or remedies available under Australian Consumer Law.
11.2 Major Failures
Where services experience a major failure, customers may be entitled to remedies available under Australian Consumer Law.
11.3 Non-Major Failures
Where a failure is not major, AD Pest & Termite Control may be entitled to rectify the issue within a reasonable period before further remedies apply.
11.4 Additional Warranties
Any warranty provided by AD Pest & Termite Control operates in addition to statutory rights and does not replace those rights.
12. Customer Default
12.1 Default Events
The customer will be in default if:
- Payment is not made when due.
- False information is provided.
- Access is refused.
- Equipment is damaged or removed.
- These Terms and Conditions are breached.
12.2 Remedies Available
Where a default occurs, AD Pest & Termite Control may:
- Suspend services.
- Terminate agreements.
- Require immediate payment.
- Recover supplied equipment.
- Cancel warranties.
- Refuse future services.
- Refer debts to collection agencies.
- Commence legal proceedings.
12.3 Immediate Payment
Upon default, all outstanding amounts become immediately due and payable.
12.4 Survival of Rights
Termination, suspension, or completion of services does not affect any rights, remedies, liabilities, warranties, payment obligations, or protections intended to survive the agreement.
13. Privacy and Information Management
13.1 Collection of Information
AD Pest & Termite Control may collect, store, use, and disclose information reasonably required for:
- Quotations
- Service delivery
- Site access
- Scheduling
- Invoicing
- Payment processing
- Warranty administration
- Compliance obligations
- Customer communication
- Quality assurance
- Record keeping
13.2 Disclosure of Information
Information may be disclosed where reasonably necessary to:
- Employees
- Contractors
- Subcontractors
- Software providers
- Accountants
- Insurers
- Legal advisers
- Debt recovery agencies
- Government authorities
- Regulatory bodies
13.3 Accuracy of Information
The customer warrants that all information supplied is accurate, complete, and authorised for disclosure.
13.4 Privacy Policy
Personal information will be handled in accordance with applicable Australian privacy legislation and AD Pest & Termite Control’s Privacy Policy.
13.5 Communication Consent
The customer consents to receiving communications relating to:
- Quotations
- Appointments
- Service reminders
- Invoices
- Warranty matters
- Compliance notices
- Service updates
by email, SMS, telephone, or other reasonable communication methods.
14. Third Party Reliance and Use of Documents
14.1 Sole Benefit of Customer
All reports, quotations, certificates, invoices, recommendations, treatment plans, photographs, diagrams, service records, and related documents are prepared solely for the benefit of the customer named in the document.
14.2 No Third-Party Reliance
No third party may rely upon any report, certificate, recommendation, quotation, or service documentation without prior written consent from AD Pest & Termite Control.
14.3 Limitation of Responsibility
AD Pest & Termite Control accepts no liability whatsoever to any third party who relies upon any information supplied by AD Pest & Termite Control.
14.4 Property Transactions
Where reports or documentation are provided during property sales, leasing arrangements, building transactions, insurance matters, or commercial transactions, any reliance by persons other than the original customer is entirely at their own risk unless otherwise agreed in writing.
15. Force Majeure
15.1 Events Beyond Control
AD Pest & Termite Control is not liable for delays, interruptions, rescheduling, suspension, or failure to perform services caused by circumstances beyond its reasonable control.
15.2 Examples of Force Majeure Events
Such events may include:
- Severe weather
- Flooding
- Fire
- Storm damage
- Earthquakes
- Pandemics
- Public health emergencies
- Government restrictions
- Utility failures
- Cyber attacks
- Software failures
- Material shortages
- Fuel shortages
- Transport disruptions
- Labour shortages
- Industrial action
- Supply chain interruptions
- Site shutdowns
15.3 Service Adjustments
Where a Force Majeure Event occurs, AD Pest & Termite Control may:
- Reschedule services
- Suspend services
- Modify service timing
- Adjust attendance dates
- Cancel services where necessary
without liability for resulting delays.
16. Insurance
16.1 Business Insurance
AD Pest & Termite Control will maintain insurance policies considered appropriate for the services provided.
16.2 Types of Insurance
Such insurance may include:
- Public Liability Insurance
- Workers Compensation Insurance
- Motor Vehicle Insurance
- Professional Indemnity Insurance (where applicable)
16.3 Customer Responsibility
Customers remain responsible for maintaining their own:
- Building insurance
- Contents insurance
- Business insurance
- Landlord insurance
- Property protection policies
16.4 No Insurance Guarantee
Pest management services are not insurance products and do not provide insurance cover against pest activity, pest damage, business interruption, property loss, or consequential losses.
17. Governing Law, Disputes and General Provisions
17.1 Governing Law
These Terms and Conditions are governed by the laws of Victoria, Australia.
17.2 Jurisdiction
The parties submit to the exclusive jurisdiction of the courts and tribunals of Victoria.
17.3 Severability
If any provision of these Terms and Conditions is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
17.4 No Waiver
Failure by AD Pest & Termite Control to exercise a right under these Terms and Conditions does not constitute a waiver of that right.
17.5 Assignment
AD Pest & Termite Control may assign, subcontract, transfer, or delegate any part of its obligations where reasonably necessary.
The customer may not assign any rights under these Terms and Conditions without prior written consent.
17.6 Survival
Any provisions relating to:
- Payment obligations
- Warranties
- Limitation of liability
- Privacy
- Intellectual property
- Debt recovery
- Indemnities
will survive completion, cancellation, suspension, or termination of services.
18. Definitions and Interpretation
18.1 AD Pest & Termite Control
Means AD Pest & Termite Control (ABN 76991175496), including its employees, contractors, technicians, subcontractors, agents, successors, and authorised representatives.
18.2 Customer
Means any individual, company, owner, occupier, tenant, landlord, real estate agent, property manager, body corporate, builder, business, organisation, government entity, or authorised representative requesting or receiving services.
18.3 Property
Means the land, building, dwelling, premises, structure, facility, workplace, commercial premises, industrial premises, or location where services are provided.
18.4 Service Address
Means the address nominated by the customer for service delivery.
18.5 Services
Means inspections, monitoring, reporting, pest management treatments, pest control services, recommendations, maintenance services, and associated activities supplied by AD Pest & Termite Control.
18.6 Equipment
Means bait stations, traps, monitoring devices, pest management systems, signage, safety devices, and associated materials supplied or installed by AD Pest & Termite Control.
18.7 Pest
Means insects, rodents, spiders, birds, termites, stored product pests, nuisance pests, and any pest species identified within service documentation.
18.8 Warranty
Means any written warranty, workmanship warranty, free service period, service guarantee, or warranty document expressly issued by AD Pest & Termite Control.
18.9 Business Day
Means a day other than a Saturday, Sunday, or public holiday in Victoria, Australia.
18.10 Force Majeure Event
Means any event beyond the reasonable control of AD Pest & Termite Control that prevents, delays, interrupts, or impacts service delivery.
18.11 Third Party
Means any person or entity other than AD Pest & Termite Control and the customer identified in the service documentation.
18.12 Written Notice
Means any notice delivered by email, letter, invoice, quotation, report, SMS, electronic communication, or other written method capable of being retained and reproduced.
Pre-Construction Termite Treatment Terms
This Termite Management Supply Agreement and the Terms and Conditions below set out the agreement between AD Pest & Termite Control and the customer named in the quotation, work order, invoice, or service agreement. It applies to pre-construction termite management services for new building work, including any associated inspection, installation, reporting, certification, maintenance, warranty administration, and customer handover requirements.
By approving the quotation, signing the service agreement, requesting the work, allowing the work to proceed, or paying any invoice, the customer confirms that they have read, understood, and accepted these terms. Where the person signing or approving the work acts for a company, builder, owner, or other entity, that person confirms they have authority to accept these terms on that party’s behalf.
These terms are written for AD Pest & Termite Control and are not a copy of any other company’s document. They are intended to protect both the customer and AD Pest & Termite Control by clearly explaining responsibilities before, during, and after termite management works.
1. Terms and commencement
1.1 This agreement starts on the earlier of the date the quotation is accepted, the date stated as the commencement date, the date works begin, or the date the customer first permits AD Pest & Termite Control to perform the services.
1.2 The initial term is the period stated in the quotation, service agreement, warranty document, or handover pack. If no specific term is stated, the agreement continues until the services are completed, all invoices are paid, and any warranty or maintenance period has expired or been terminated in accordance with these terms.
1.3 Where recurring inspections, monitoring, servicing, or warranty maintenance are included, the agreement may renew for further periods if both parties continue with the arrangement, unless either party gives written notice ending the arrangement.
1.4 AD Pest & Termite Control may update fees for renewal periods, additional inspections, maintenance visits, or variation works by providing a new quote or written notice. If the customer does not accept the updated fee, either party may end the future recurring services by giving reasonable written notice.
1.5 Termination of future services does not remove the customer’s obligation to pay for work already performed, materials supplied, equipment installed, attendance fees, or other amounts properly owing.
2. Entire agreement
2.1 These terms, together with the quotation, scope of works, service agreement, treatment plan, report, invoice, warranty document, certificate, and any written variations, form the whole agreement between the parties for the services.
2.2 Any previous discussions, estimates, representations, advertisements, or informal communications are replaced by the final written agreement, except where they are expressly included in writing.
2.3 To the extent permitted by law, AD Pest & Termite Control excludes all warranties, guarantees, representations, and conditions except those expressly stated in writing or required by law.
2.4 If there is any inconsistency between these terms and a specific written quotation or treatment plan, the specific written quotation or treatment plan applies to the extent of the inconsistency.
3. Provision of services
3.1 AD Pest & Termite Control will use reasonable care and skill to provide the services described in the accepted quotation or service agreement.
3.2 Services may include pre-construction chemical soil treatments, reticulation systems, physical termite management components, collars, membranes, perimeter systems, slab edge treatments, inspections, reports, certificates, and associated recommendations, depending on the accepted scope.
3.3 The customer must provide safe, timely, and reasonable access to the service address, including access to the relevant construction areas, plans, water, power, and other facilities reasonably required to complete the work.
3.4 AD Pest & Termite Control may refuse, postpone, suspend, or limit services where access is not available, the site is unsafe, weather makes the work unsuitable, the work area is not ready, payment is overdue, or conditions prevent the service being completed properly.
3.5 If attendance is attempted but work cannot proceed because of the customer, builder, site manager, access restrictions, unsafe conditions, or lack of site readiness, AD Pest & Termite Control may charge a reasonable attendance, waiting, cancellation, or rescheduling fee.
3.6 The customer must ensure all persons not required for the work remain clear of the treatment or installation area when requested by the technician.
4. Site information, hazards and utilities
4.1 Before work starts, the customer must tell AD Pest & Termite Control in writing about all known site hazards, underground services, pipes, drains, cables, conduits, structural elements, hydraulic services, asbestos risks, contaminated materials, or other matters that could affect safety or installation.
4.2 The customer is responsible for obtaining and providing accurate information about hidden or underground services. AD Pest & Termite Control is entitled to rely on the information provided by the customer, builder, site supervisor, owner, plans, or other authorised representatives.
4.3 Where drilling, trenching, cutting, injection, soil treatment, or installation work is required, AD Pest & Termite Control is not responsible for damage caused by inaccurate, incomplete, missing, or late information about hidden services or hazards.
4.4 If a health or safety incident, site hazard, or damage event occurs before, during, or after the services, the customer must notify AD Pest & Termite Control as soon as possible and provide relevant details.
4.5 The customer must maintain the service address as a safe working environment and must comply with all site safety requirements, inductions, access rules, and legal obligations applying to the construction site.
5. Equipment, systems and materials
5.1 AD Pest & Termite Control may supply or install equipment, systems, components, materials, chemicals, monitoring stations, reticulation lines, collars, membranes, or other termite management products as part of the services.
5.2 Unless otherwise stated in writing, ownership of supplied equipment and materials passes only when payment has been received in full. Any equipment placed temporarily or retained for monitoring remains the property of AD Pest & Termite Control unless sold to the customer in writing.
5.3 The customer must not move, damage, tamper with, cover, remove, alter, obstruct, or interfere with any termite management system, treated zone, reticulation system, monitoring station, physical barrier, label, certificate, or installed component.
5.4 The customer must notify AD Pest & Termite Control promptly if any equipment, system, treated area, slab penetration, perimeter area, or termite management component is damaged, altered, exposed, disturbed, or suspected to be defective.
5.5 If equipment or systems are damaged, stolen, misused, or require replacement because of the customer, builder, subcontractor, homeowner, occupier, or other persons on site, AD Pest & Termite Control may charge the reasonable cost of repair, replacement, attendance, and administration.
6. Variations and additional services
6.1 The customer may request additional services, changes to the scope, extra visits, re-treatment, repairs, inspections, reports, certifications, or equipment. AD Pest & Termite Control may provide a separate quote for those variations.
6.2 AD Pest & Termite Control is not required to perform variation work unless the variation is accepted in writing and any required payment arrangements are confirmed.
6.3 A reduction or cancellation of part of the work after acceptance may not result in a direct pro-rata reduction. AD Pest & Termite Control may take into account materials ordered, labour allocated, administration, travel, site set-up, and lost scheduling capacity.
6.4 Any additional cost caused by site delays, changes to construction staging, re-booking, poor site preparation, inaccessible areas, or altered plans may be charged to the customer where reasonable.
7. Service effectiveness and customer maintenance
7.1 AD Pest & Termite Control will use reasonable endeavours to provide services in a competent and professional manner. However, termite management systems are risk-reduction measures and do not provide an absolute guarantee that termites will never enter or damage a property.
7.2 The ongoing effectiveness of any treatment or system depends on the customer following all written and verbal recommendations, maintaining inspection schedules, preventing disturbance of treated areas, and promptly reporting changes or suspected termite activity.
7.3 Treatment effectiveness may be reduced or made ineffective by excavation, landscaping, concreting, paving, plumbing works, drainage changes, water leaks, poor ventilation, high moisture, building alterations, renovations, untreated additions, bridging of barriers, stored timber, poor hygiene, or introduction of infested materials.
7.4 The customer must ensure future owners, builders, occupiers, tenants, and site contractors are informed of the termite management system and must take reasonable steps to prevent disturbance or concealment of the system.
7.5 Regular timber pest inspections are strongly recommended at least every 12 months, or more frequently for high-risk sites, wet areas, bushland areas, known termite zones, or where recommended in the report.
8. Payment and trading terms
8.1 The customer must pay all amounts stated in the quotation, invoice, service agreement, or written variation. Unless otherwise stated, prices are exclusive of GST and GST will be added where applicable.
8.2 Payment is due by the date stated on the invoice. If no date is stated, payment is due within 7 days of invoice for one-off works and within 30 days for approved commercial accounts.
8.3 AD Pest & Termite Control may withhold reports, certificates, warranty documents, handover packs, further services, or future bookings until overdue amounts are paid in full.
8.4 The customer must not deduct, set off, or withhold payment for any amount unless AD Pest & Termite Control has agreed in writing or the law requires otherwise.
8.5 If an invoice is disputed, the customer must notify AD Pest & Termite Control in writing within 14 days of the invoice date and must pay all undisputed amounts by the due date.
8.6 If payment is overdue, AD Pest & Termite Control may charge reasonable debt recovery costs, legal costs, collection agency fees, bank fees, interest, and administration costs to the extent permitted by law.
8.7 Any fees for site inductions, subscriptions, environmental levies, permits, parking, tolls, waste disposal, or special site compliance requirements may be charged to the customer where reasonably incurred for the services.
9. Credit and commercial accounts
9.1 Commercial credit is available only if approved by AD Pest & Termite Control. AD Pest & Termite Control may decline credit, reduce credit limits, require payment in advance, or change payment terms where reasonable.
9.2 Where the customer requests or receives commercial credit, the customer authorises AD Pest & Termite Control to make reasonable enquiries about the customer’s payment history, trading history, and creditworthiness, subject to applicable privacy laws.
9.3 AD Pest & Termite Control may disclose overdue debts to debt recovery providers, legal advisers, credit insurers, or other relevant service providers where reasonably necessary for payment recovery and permitted by law.
10. Suspension and termination
10.1 Either party may terminate future recurring services by giving written notice in accordance with the accepted quotation or service agreement. If no period is stated, one month’s written notice is required for recurring services.
10.2 AD Pest & Termite Control may suspend or terminate services immediately if the customer fails to pay, refuses access, provides unsafe working conditions, interferes with equipment or systems, gives misleading information, or seriously breaches these terms.
10.3 On termination, all amounts for work performed, materials supplied, equipment installed, attendance, variations, and approved costs become immediately payable.
10.4 Termination does not affect rights and obligations that are intended to continue, including payment obligations, liability limitations, privacy obligations, intellectual property rights, warranty conditions, and definitions.
11. Limitation of liability
11.1 To the extent permitted by law, AD Pest & Termite Control is not liable for indirect, special, or consequential loss, including loss of profit, loss of rent, loss of opportunity, business interruption, delay costs, loss of production, loss of goodwill, or loss arising from future termite activity beyond the accepted service scope.
11.2 Where liability cannot be excluded, and the goods or services are not ordinarily acquired for personal, domestic, or household use, AD Pest & Termite Control’s liability is limited, where permitted by law, to resupplying the services, paying the cost of resupply, replacing the goods, or paying the cost of replacement.
11.3 AD Pest & Termite Control is not liable for loss, damage, or reduced effectiveness caused by the customer’s failure to follow written or verbal instructions, failure to maintain inspections, disturbance of treated areas, construction changes, undisclosed hazards, or actions of builders, subcontractors, owners, occupiers, tenants, or third parties.
11.4 Each party must take reasonable steps to reduce and mitigate any loss, damage, claim, cost, or liability.
11.5 Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded.
12. Australian Consumer Law and statutory rights
12.1 Nothing in these terms excludes, restricts, or modifies rights, guarantees, remedies, or protections that cannot be excluded under the Australian Consumer Law or other applicable legislation.
12.2 For major failures with services, consumers may be entitled to cancel the service contract and receive a refund for the unused portion or compensation for reduced value. Consumers may also be entitled to compensation for reasonably foreseeable loss or damage.
12.3 Where a failure is not major, the customer may be entitled to have the issue remedied within a reasonable time. If this is not done, the customer may have further rights under the Australian Consumer Law.
12.4 Any voluntary warranty offered by AD Pest & Termite Control is in addition to, and does not replace, non-excludable statutory rights.
13. Warranty and service claims
13.1 Any termite treatment warranty, service period, free service period, or maintenance warranty applies only if it is confirmed in writing by AD Pest & Termite Control.
13.2 Unless a different period is stated in writing, any limited service warranty for pre-construction termite treatment is 12 months from the date of completion of the relevant treatment or installation.
13.3 Warranty coverage is conditional on full payment, compliance with all recommendations, no disturbance of treated areas or systems, no relevant building alteration without notification, and ongoing inspections at the interval recommended by AD Pest & Termite Control.
13.4 The warranty does not cover damage, timber replacement, structural repair, loss caused by undetected or future termite activity, drywood termites, European house borer, fungal decay, moisture damage, or pests outside the written scope unless expressly stated in a separate written warranty.
13.5 If the customer believes there is a warranty issue, the customer must contact AD Pest & Termite Control promptly at info@adpestcontrol.com.au and allow reasonable access for inspection.
13.6 If AD Pest & Termite Control determines that re-supply or remedial service is appropriate, the remedy may be limited to re-inspection, re-treatment, repair of the termite management component, or re-supply of the relevant service, subject to Australian Consumer Law.
14. New homeowner handover
14.1 Where the customer is a builder, developer, contractor, or seller, the customer must provide the new homeowner or purchaser with the termite management documentation supplied by AD Pest & Termite Control.
14.2 The handover information should include the treatment certificate, treatment zone or system description, relevant plans if available, warranty conditions, inspection recommendations, and instructions not to disturb termite management systems.
14.3 A new homeowner should be advised that ongoing timber pest inspections are required and that any signs of termite activity, weakened timber, mud tubes, moisture issues, or damage must be reported promptly.
14.4 Any transfer of warranty benefit to a new homeowner is subject to written approval by AD Pest & Termite Control and compliance with all warranty conditions.
14.5 Nothing in this agreement makes AD Pest & Termite Control the principal contractor or builder for the construction project.
15. GST
15.1 Where GST applies to a supply made under this agreement, the customer must pay the GST amount in addition to the GST-exclusive price.
15.2 AD Pest & Termite Control will provide a tax invoice where required by law.
16. Inability to deliver services
16.1 Neither party is responsible for delay or failure to perform obligations, other than payment obligations, where the delay or failure is caused by events beyond reasonable control.
16.2 Such events may include severe weather, flood, fire, accident, shortage of materials, supplier delay, transport interruption, government restriction, pandemic, cyber event, site shutdown, industrial action, unsafe conditions, or a direction from an authority.
16.3 Where such an event occurs, AD Pest & Termite Control may reschedule, vary, suspend, or cancel affected services and will use reasonable efforts to communicate with the customer.
17. Modern slavery and lawful conduct
17.1 AD Pest & Termite Control aims to conduct business ethically and to reduce the risk of modern slavery, exploitation, and unlawful conduct in its operations and supply chain.
17.2 The customer must not require AD Pest & Termite Control or its technicians to act unlawfully, unsafely, or contrary to label directions, licensing requirements, workplace safety rules, or applicable standards.
18. Insurance
18.1 AD Pest & Termite Control will maintain insurance considered appropriate for its pest management activities, which may include public liability insurance and workers compensation insurance where required.
18.2 Insurance details may be provided on request where reasonably required for a project, tender, induction, or site compliance process.
19. Privacy
19.1 AD Pest & Termite Control may collect, use, store, and disclose customer information for purposes connected with quoting, service delivery, site access, invoicing, payment recovery, reports, certificates, warranty administration, reminders, compliance, and customer communication.
19.2 Customer information may be disclosed to technicians, contractors, insurers, legal advisers, debt recovery providers, software providers, regulators, or other service providers where reasonably necessary for the services or permitted by law.
19.3 Customers may request access to or correction of personal information by contacting AD Pest & Termite Control at info@adpestcontrol.com.au.
19.4 Where the customer provides details of a new homeowner, purchaser, tenant, site manager, or other person, the customer warrants that they are permitted to provide those details for service, warranty, and handover purposes.
20. Intellectual property
20.1 Reports, templates, treatment plans, diagrams, service documents, photos, recommendations, certificates, and other materials prepared by AD Pest & Termite Control remain the intellectual property of AD Pest & Termite Control unless otherwise agreed in writing.
20.2 The customer receives a limited right to use those documents for the relevant property, construction project, compliance requirement, handover, insurance, or maintenance purpose.
20.3 The customer must not copy, modify, rebrand, resell, publish, or reuse AD Pest & Termite Control documents for unrelated projects or third-party commercial purposes without written permission.
21. Governing law and general terms
21.1 This agreement is governed by the laws of the Australian state or territory where the services are performed, unless otherwise stated in writing.
21.2 The parties submit to the courts and tribunals of that state or territory.
21.3 AD Pest & Termite Control may assign or transfer its rights and obligations where reasonable, including in connection with business restructuring, sale, or subcontracting. The customer may assign rights only with written consent.
21.4 If any clause is invalid or unenforceable, that clause is to be read down or severed to the extent necessary, and the remaining clauses continue to apply.
21.5 Rights and remedies under this agreement are cumulative and do not exclude rights available by law.
22. Product recalls and regulatory issues
22.1 If AD Pest & Termite Control becomes aware of a recall, regulatory issue, product safety concern, or label change relevant to a product or component used in the services, it may notify affected customers where reasonably required.
22.2 The customer must provide reasonable assistance and access where required to manage any recall or regulatory issue connected with the services.
23. Notices
23.1 Any notice under this agreement must be in writing and may be delivered by hand, post, or email to the address or email address last notified by the recipient.
23.2 Notices to AD Pest & Termite Control may be sent to info@adpestcontrol.com.au unless another notice address is stated in the quotation or service agreement.
23.3 The customer must notify AD Pest & Termite Control of any change to name, billing address, service address, email, phone number, ownership, site contact, or authorised representative.
24. Definitions
24.1 Australian Consumer Law means Schedule 2 to the Competition and Consumer Act 2010 (Cth).
24.2 Customer means the person, builder, company, owner, developer, agent, or authorised representative requesting or accepting the services.
24.3 Equipment means termite management equipment, monitoring equipment, reticulation components, physical barrier components, collars, materials, or other items supplied or installed as part of the services.
24.4 Handover Pack means the documents provided for the owner or future homeowner, which may include certificates, plans, warranty conditions, service recommendations, and inspection requirements.
24.5 Property means the building, land, construction site, structures, gardens, fences, and relevant areas at or near the service address within the scope of the accepted service.
24.6 Service Address means the address where services are to be performed.
24.7 Services means the pre-construction termite treatment, inspection, reporting, installation, maintenance, monitoring, certification, warranty, or other pest management services supplied by AD Pest & Termite Control.
24.8 System means a termite management system, treatment zone, chemical barrier, physical barrier, reticulation system, monitoring arrangement, or other pest management system supplied or installed by AD Pest & Termite Control.
24.9 Termites means subterranean termites and dampwood termites commonly referred to as white ants, unless a different meaning is stated in writing. It does not include drywood termites unless expressly included.
24.10 Timber Pests may include subterranean termites, dampwood termites, borers of seasoned timber, and wood decay fungi where included in the written scope. Drywood termites and European house borer are excluded unless expressly stated in writing.
